Learning outcomes

The Employment (Allocation of Tips) Act 2023 passed into law in May 2023 and is set to take effect on 1st July 2024. It represents a significant milestone in reinforcing the rights of hospitality teams to retain their tips. Historically, varying regulations existed, but this new Act aims to provide clearer and more robust protection for team members, ensuring fair treatment and allocation of tips.

This activity aims to introduce team members to the Employment (Allocation of Tips) Act 2023, to increase their understanding of what the legislation covers and their rights moving forward. A draft Code of Practice to accompany the Act is still currently in development; as and when more information is released, the course will be updated.

Course details

By the end of this course, you will be able to:

Recognise key provisions of the ‘Fair Tipping Act’
Define your rights regarding tips, gratuities and service charges
Explain the implications and relevance to your role
Understand what The Employment (Allocation of Tips) Act 2023 is, and a brief outline of the Act
Understand who is eligible for a share of tips and service charges
Know the contractual rights
Understand how tips will be distributed, alongside tronc arrangements
Know what to do if you feel you are being paid unfairly, or if you feel the way tips are shared is not
fair

Assessment

How long will it take? 15 minutes.

What type of assessment is it? When you finish the course, you’ll complete an end-of-learning online assessment consisting of 5 questions. 80% of the questions will need to be answered correctly in order to pass.

What will I receive? Once you’ve passed the assessment included in the course, your digital certificate will be available on the platform.

How long is it valid for? Up to 1 year after purchase.
